An arbitrator rejected the Hanif, Nishihama, Katiushinksy and Greer defense and ordered Northern California Regional Liability Excess Fund to pay damages after the Fund refused to pay any benefits. The landmark decision is believed to be the first successfully litigated claim of its kind and a victory for public school teachers and employees who have been seriously injured while on the job.
